Please read these Terms and Conditions carefully. They set out the basis on which we accept bookings and provide our tours and services. By making an enquiry, a booking, or a payment with us, you confirm that you have read, understood, and agreed to these terms.

1. Definitions

  • “We”, “us”, “our” means Sani Pass and Lesotho Private Tours (Pty) Ltd (Registration No. 2019/038728/07), trading as
    Sani Pass & Lesotho Private Tours, of  Himeville, KwaZulu-Natal, 3256, South Africa.
  • “You”, “your”, “the client” means the person making the booking and every traveller included in it.
  • “Tour” means any day tour, multi-day overland tour, hike, activity, or custom itinerary we provide.
  • “Supplier” means any third party we engage to deliver part of your tour, such as accommodation, activity providers, or partner operators.

2. About us

We are a private and custom guided-tour operator based in the Underberg area of KwaZulu-Natal, South Africa, offering Sani Pass day tours and multi-day Lesotho overland tours, along with hikes, horse riding, and tailor-made journeys into Lesotho and, on request, Eswatini.

3. Enquiries and quotations

Most of our tours, and all of our overland and custom journeys, are arranged on an enquiry basis. Because availability depends on the mountain lodges and suppliers we work with, we confirm what is possible before we quote. A quotation is based on the details you give us and the availability at the time. Quotations are valid for the period stated on them and may change if your requirements change, if availability changes, or if there are changes in supplier costs, exchange rates, or taxes before a booking is confirmed.

4. Bookings and confirmation

A booking is only confirmed once we have received your written acceptance of the quotation and the required deposit or full payment, and we have sent you a written confirmation. The person making the booking confirms that they are 18 or older and that they are authorised to make the booking on behalf of every traveller included in it, and to accept these terms on their behalf.

5. Prices, inclusions, and exclusions

Prices are quoted in South African Rand (ZAR) unless stated otherwise. What is included and excluded is set out in your quotation and itinerary. Unless stated, prices do not include items of a personal nature, gratuities, optional activities, or travel insurance. We reserve the right to correct errors in advertised or quoted prices before a booking is confirmed.

6. Payment

Payments are processed securely through our third-party payment provider and the banks and card networks involved in the transaction. We accept the payment methods shown at checkout or advised to you at the time of booking.

  • Overland and multi-day tours: a 50% deposit is required to confirm your booking. The remaining balance is due no later than 30 days before departure. If you book within 30 days of departure, full payment is required to confirm the booking.
  • Day tours and activities: payment is due in full no later than 7 days before the tour date, or at the time of booking where an online booking option is offered.

If a balance is not paid by its due date, we may treat the booking as cancelled by you and apply the cancellation terms in our Refund Policy.

7. Cancellations, changes, and refunds

Cancellations and refunds are governed by our Refund Policy, which forms part of these Terms and Conditions. Please read it together with these terms. In summary, overland tours are fully refundable if cancelled 30 or more days before departure and non-refundable within 30 days, and day tours are fully refundable if cancelled 7 or more days before the tour date and non-refundable within 7 days. If you wish to change the dates, travellers, or details of a confirmed booking, please contact us as soon as possible. We will do our best to accommodate changes, but they depend on availability and may result in additional costs.

8. Changes or cancellation by us

We plan every tour carefully, but mountain travel depends on conditions we cannot always control. We reserve the right to alter, substitute, or amend routes, accommodation, activities, or timings where necessary for your safety or comfort, or for operational reasons such as weather, road or pass conditions, or supplier availability. Where a change is minor, we will do our best to keep the experience equivalent.

If we have to cancel a tour entirely, or make a major change that you do not accept, you may choose a full refund of the amounts you have paid to us for that tour, or an alternative date or tour of equivalent value where available. Beyond this, we are not liable for any additional costs you may incur, such as flights, connecting transport, or accommodation booked separately.

9. Your responsibilities and conduct

You are responsible for arriving at the agreed time and place, for being reasonably fit for the tour you have chosen, and for behaving in a way that is safe and respectful to your guide, other travellers, our suppliers, and the communities and environments we visit. We may decline or discontinue a traveller’s participation, without refund, where their conduct or state of health creates a risk to themselves or others. You are responsible for any loss or damage you cause.

10. Passports, visas, and border crossings

Our Lesotho tours cross an international border. You are responsible for holding a valid passport and any visas or documents required for your nationality, with sufficient validity and blank pages, and for meeting any health or entry requirements. We can offer general guidance, but we cannot accept responsibility for any refusal of entry, delay, or cost arising from incorrect or incomplete travel documents.

11. Health, fitness, and altitude

Our tours travel to high altitude on mountain roads. You should be in reasonable health for the tour you book, and you must tell us in advance, in writing, about any medical condition, mobility need, or requirement that may affect your participation or safety, so we can advise you and make suitable arrangements. We reserve the right to decline participation where we reasonably believe a tour is not suitable on safety grounds.

12. Travel insurance

We strongly recommend that all travellers hold comprehensive travel insurance for the duration of their trip, including cover for cancellation, curtailment, medical expenses and evacuation, personal liability, and baggage. We are not responsible for any loss, cost, or expense that could have been covered by appropriate travel insurance.

13. Our liability

We take great care in arranging and running our tours. To the extent permitted by law, we are not liable for any loss, damage, injury, death, delay, or inconvenience arising from events beyond our reasonable control, from the acts or omissions of third-party suppliers, or from your own failure to comply with these terms, travel requirements, or the reasonable instructions of your guide. Nothing in these terms limits any liability that cannot lawfully be limited.

14. Third-party suppliers

Where we arrange accommodation, activities, or services provided by third-party suppliers, we do so as a booking agent on your behalf. Those services are also subject to the suppliers’ own terms and conditions. We are not responsible for the acts, omissions, or default of any supplier, but we will assist you where we reasonably can if a problem arises.

15. Force majeure

We are not liable for any failure or delay in providing your tour caused by events beyond our reasonable control, including severe weather, natural disasters, fire, flood, road or pass closures, border closures, strikes, civil unrest, war or terrorism, disease outbreaks, or government restrictions.

16. Complaints

If something is not right during your tour, please tell your guide or contact us immediately so we have the opportunity to put it right at the time. If a concern cannot be resolved on the day, please send us a written complaint within 7 days of the end of your tour so we can investigate it fully.

17. Privacy

We handle your personal information in accordance with our Privacy Policy, which explains what we collect, how we use it, and your rights under the Protection of Personal Information Act (POPIA).

18. Website use and intellectual property

The content on our website, including text, images, and branding, belongs to us or our licensors and may not be copied or reused without our permission. You agree to use our website lawfully and not in any way that could damage or interfere with it.

19. Governing law

These Terms and Conditions are governed by the laws of the Republic of South Africa, and any dispute arising from them is subject to the jurisdiction of the South African courts.
